Cross-Border AI Compliance

The EU AI Act mandates conformity assessment; the UK relies on sector regulators; the US has no single framework. An AI system deployed across all three faces three different compliance pathways — and satisfying one does not satisfy the others.

Different jurisdictions impose different data residency requirements. EU data sovereignty, US CLOUD Act obligations, and emerging data localisation laws create tension for AI systems trained on cross-border datasets.

No mutual recognition framework exists for AI compliance. A conformity assessment under the EU AI Act does not satisfy UK requirements, and vice versa. Organisations must maintain parallel compliance programmes for each jurisdiction.

What is prohibited varies by jurisdiction. EU bans social scoring and emotion recognition in workplaces. Other jurisdictions may permit these practices. Organisations must implement the most restrictive standard to avoid jurisdiction-specific violations.

Each framework requires different documentation. EU AI Act demands Annex IV technical documentation. The UK expects principle-based assessments. US regulators want sector-specific evidence. Maintaining parallel documentation sets is resource-intensive.

The EU AI Act applies to non-EU providers whose AI output is used in the EU. This extraterritorial reach means that a US-based provider selling to EU customers must comply with the full EU AI Act — creating dual compliance obligations.
